By accessing and using Fuel iX and related services (collectively the "Services") offered by TELUS International (Cda) Inc. or one of its subsidiaries, including WillowTree LLC, (collectively “TELUS International” or “us” or “we”) you agree to be legally bound by the following terms (these “User and Service Terms”). In these User and Service Terms “you”, “yourself” and “your” refer to any person accessing or using the Services. IF YOU DO NOT AGREE TO THESE USER AND SERVICE TERMS, YOU MAY NOT ACCESS OR USE THE SERVICES.
TELUS International reserves the right at its sole discretion to update these User and Service Terms at any time. Updates will be effective five (5) business days after posting on this site. It is your responsibility to check the site periodically for changes. Your continued access and use of the Services following the posting by TELUS International of updated terms on this site will mean that you accept and agree to the updated terms.
Services in the areas of generative AI and machine learning are in the developmental stage and still evolving. As such, output from the Services may be inaccurate, inappropriate, biased or potentially offensive. Continuous AI model training over time is required to be able to address deficiencies and provide a service with consistently high quality output. For this reason TI advises, and you acknowledge and agree that, output from the Services: (a) should not be relied upon as a sole source for information or as a substitute for diligence and where applicable review by a qualified professional; (b) should always be checked for accuracy and contextual appropriateness for the intended use case; and (c) should not be used for making a decision about an individual which may materially impact the individual, including eligibility for credit or housing, hiring, criminal justice matters and social scoring and other acceptance and award criteria.
TELUS International is providing you with access and use of the Services at no charge as Beta services for the purposes of allowing us to test, evaluate and improve the Services. Accordingly, TELUS International provides no assurances that the Services are or will be available, complete, reliable or error-free and is making the Services available "as is" without representation, warranty or condition of any kind, either express, implied or statutory including implied representations, warranties or conditions of merchantability, fitness or suitability for a particular purpose, non-infringement of intellectual property rights or inter-operability of products or services. For this Beta trial, TELUS International disclaims any responsibility for or obligation regarding compliance with laws, rules, and regulations, including but not limited to those regarding privacy and data security (such as the General Data Protection Regulation, Payment Card Industry Standards, SOC and/or ISO standards). Participants in the Beta trial are responsible for ensuring their own compliance with applicable laws and standards.
Your access and use of the Services is subject to the Fuel iX Beta Service Terms.
TELUS International and our partners own all rights in and to the Services, including intellectual property rights. You may not use the name or trademarks of TELUS International or any of our partners without our express written approval.
You are required to create a user account with TELUS International in order to obtain the Services. You are responsible for: (a) maintaining the confidentiality of your account, including your login username and password; and (b) the actions of individuals accessing or using the Services through your TELUS International account whether or not actually authorized by you, and actions by such individuals will be deemed to be actions by you. You will promptly notify TELUS International if: (c) your account has been compromised, or (d) you or your organization is subject to a DoS or other malicious attack that may impact the Services.
TELUS International and its partners deploy industry standard tools to help protect against the introduction and propagation of malicious programs in our IT environments including viruses, worms, malware and other forms of contamination or harmful activity (collectively “Malware”). However, TELUS International assumes no responsibility and shall not be liable for any damages caused by Malware that may infect or otherwise damage your computer equipment or other property in connection with your access to or use of the Services.
Neither TELUS International nor any of its partners shall be liable for any direct, indirect, incidental, special, consequential, punitive or other damages including business interruption, loss of use, data, information or profits (regardless of the form of action, including but not limited to contract, negligence or other tortious act) arising out of or in connection with your access or use of, or inability to use, the Services even if TELUS International has been advised of, or foresees the possibility of, any such damages occurring.
You agree to indemnify and hold TELUS International and its partners harmless from and against all claims, liabilities, costs and expenses, including reasonable legal fees, related to a violation of these User and Service Terms by you or in connection with your access or use of the Services.
Where you breach these User and Service Terms, in addition to any other rights TELUS International or its partners may have, TELUS International may at its sole discretion and without notice immediately restrict, suspend or terminate your access to the Services without compensation or liability.
You agree that regardless of where you are located or access the Services, these User and Service Terms will be governed by, and construed in accordance with, the laws of the State of New York U.S.A. Any dispute or legal action related to these User and Service Terms or your access or use of the Services will be governed exclusively by the Courts of New York, U.S.A.
